A spokesperson for the Georgia-based retailer said, “Although we will always follow the law, we want our customers to know that they can continue to count on us. Our commitment to our customers remains steadfast despite the recent claim by the FDA that it may ban the importation of e-cigs in the the country.”
The spokesman is referring to at least the second time that someone at the Federal Food and Drug Administration has said the importation of the devices would be banned. The first so-called ban, was overturned by Judge Leon Reply in 2009 who wrote in his decision that despite “hundreds of thousands of electronic cigarettes” having already been sold in the U.S., the “FDA cites no evidence that those electronic cigarettes have endangered anyone. Nor has FDA cited any evidence that electronic cigarettes are any more an immediate threat to public health.”
