In this long, drawn-out case a Medical Doctor was charged with felony Criminal Trespass and misdemeanor Defiant Trespass charges. At the preliminary hearing on 3/19/2013 in front of Judge Wendy Pew, the Felony charge was dismissed after a contested preliminary hearing with 2 witnesses for lack of evidence of the felony. The misdemeanor charge was remanded to municipal court. The Commonwealth then attempted to refile the felony charge and their motion was held in front of Judge Paula Patrick on 6/18/2013, whereby the Commonwealth’s motion was lost, disabling their ability to bring back the felony charge.
The case was then listed for a bench trial numerous times but finally occurred on 11/21/2013 in front of Judge Karen Y. Simmons. The case began on that date with the Defendant pleading Not Guilty and then was bifurcated until another date so the Commonwealth could contact their witnesses and the case could stay with Judge Karen Simmons. On 1/29/2014 the trial was finally heard in front of Judge Karen Y. Simmons. The Commonwealth requested to amend the charges to allow another charge to be heard but the judge denied their motion, and then afterwards ruled that the client be found NOT GUILTY of all charges.
