After the accident occurred and the initial claim was made, the defendant insurance company did not attempt to settle, or even acknowledge, the plaintiff’s property damage claim. After litigation began, the insurance company remained passive on the property damage claim as the case was pending for almost two years. The defendant insurance company finally addressed the plaintiff’s property damage claim at mediation less than one month before trial was to commence. About The Case
During the pre-litigation process, the defendant driver’s insurance company was placed on notice of the plaintiff’s claim, but made no settlement offer. After litigation proceedings began, the case was made on the plaintiff’s claims that he suffered severe bodily injuries and damages to property resulting from the defendant driver’s negligence. A settlement was agreed upon during mediation, but as it took two years for the defendant insurer to acknowledge the property damage claim. Gladstein Law Firm subsequently pursued a third-party insurance bad faith claim against the driver’s insurance company due to its failure to address the property damage claim for almost two years. The insurance bad faith claim was pursuant to Kentucky common law and the Kentucky Unfair Claims Settlement Practices Act, KRS 304. 12-230 and was based upon the defendant insurance company’s failure to acknowledge or settle the plaintiff’s original property damages claim. On November 5th, 2013, the insurance company settled with the plaintiff for $50,000.00.
