Perkasie, PA -- (ReleaseWire) -- 08/01/2014 --A 6 page judicial decision in favor of a dog bite victim’s rights was filed on case #2013-CV-11100 in the Dauphin County Court of Common Pleas. Pennsylvania dog attack lawyer, Thomas J. Newell, had successfully argued that the PA Dog Law permitted strict liability claims for all PA dog bite victims seeking to be reimbursed for their medical expenses.

DOG ATTACK FACTS

In his Complaint filed on December 19, 2013, Attorney Newell alleged that his client had been attacked by 3 boxers on 11/21/12. She was delivering a Federal Express package when the pack of dogs surrounded her and bit her several times on her lower torso.

LEGAL PROCEEDING

The defense attorney filed Preliminary Objections on 1/13/14 and Oral Argument took place on May 16, 2014 in front of Judge William T. Tully. Attorney Newell successfully argued that Section 459-502(b)(1) of the PA Dog Law imposed strict liability on the part of dog owners whose pets attacked humans.

LEGAL PRECEDENT

To the best of Attorney Newell’s knowledge, this is the first decision in Pennsylvania that mandates strict liability on a dog owner in a civil case for personal injuries.
