Under the proposal, the Board suggests that the fee transition follow the RBRVS ("resource-based relative value scale"), as is done in Medicare. According to most Bronx Workers Compensation Attorneys and analysts, this move could make it harder for seriously injured workers to find proper health care.
A spokesperson for the Harris Law Group says that instead of providing incentives and improving the health care system, the move will reduce the quality of specialists and health care providers that can look after injured workers. The proposed RBRVS also doesn't account for the red tape and work that this will place on health care providers under the prevailing setup.
As it is, the difficult medical billing schedule, intricacy of the Medical impairment Guidelines and restrictions on the Medical Treatment Guidelines limit the number of providers that take part in the system. If the system undergoes the changes proposed by the Board, it becomes even more complex and discourage qualified physicians and specialists from joining.
