Florida has a No-Fault law, or Personal Injury Protection law, meaning that if you are injured in an accident, you will receive insurance compensation regardless of whether you are at fault. Recently, however, Florida made changes to its PIP law, which will take effect on January 1, 2013. This legislation is called HB 119.

PIP (personal injury protection) insurance is an insurance policy that was designed to help all drivers. It has a no-fault status, meaning that whether you caused the accident, or another driver is at fault, you still receive insurance benefits in the case of injury. Within the state of Florida, all drivers who own and register a vehicle must have auto insurance. To maintain Florida registration and receive a license plate, drivers must meet PIP requirements by carrying at least $10,000 in PIP insurance. Florida law states that a PIP policy covers 80% of medical expenses and 60% of lost wages as a result of the accident. If the insured person paid for the minimum policy requirement of $10,000, then this will be the maximum amount paid; if the insured person paid for a higher amount than required by law, that amount is the cap.

Personal injury attorneys frequently hear from individuals who seek representation because they did not know that their car, truck, or motorcycle was inadequately insured. For example, many insurance companies charge an extra premium on motorcycle insurance for what is called “Guest Passenger Liability.” What this means is that the company requires an extra premium to cover any passengers you have with you on your motorcycle. Without this coverage, you are left completely uninsured for your passenger’s lost wages, hospital bills, and injuries in the event that you are involved in an accident. Surely, you would expect insurance companies to be transparent about this fact. However, there are many insurance companies which do not point out this hole in your insurance. This is why you need to learn how to decipher insurance jargon and determine the full extent of your insurance coverage. It could save you thousands in the event of an accident. We have compiled some explanations of common insurance terms below.
